Rebit™ Limited Warranty

The warranty provided by the Rebit™ Company in this Statement of Limited Warranty applies on Rebit™ products purchased and used in the United States by the original purchaser and is limited to the terms set forth below. The Rebit™ products are comprised of hardware and software components for which the Rebit™ Company provides separate limited warranty terms and conditions. The term "Hardware" means the physical Rebit™ unit and cable, and does not include any software programs, whether pre-loaded with the Hardware, or Rebit™ Company supplied CD media, or otherwise. The term “Software” includes software programs pre-loaded with the Rebit™ Hardware, residing on Rebit™ Company-supplied CD media, or installed subsequently as a Software update. Nothing in this Statement of Limited Warranty affects any statutory rights of you, as a consumer, that cannot be waived or limited by contract.

Hardware Warranty

Hardware warranty period – three (3) years from date of original purchase.

The Rebit™ Company warrants that the Rebit™ product Hardware is: (a) free from defects in materials and workmanship encountered in normal use of the product; and (b) conforms to its published documentation. The warranty period for the Hardware is a specified, fixed period defined above and commencing on the date of purchase. The original dated bill of sale must be presented to Rebit™ Company as proof of product purchase date. If, during the warranty period, the Hardware is not in good working order, Rebit™ Company will, at its sole option, repair or replace it at no additional charge, except as is set forth below.

Warranty for Software

Software warranty period – ninety (90) days from date of original purchase.

Rebit™ Company provides a ninety (90) day limited software warranty to licensees of Rebit™ Company Software accompanying Rebit™ Company Hardware. Rebit™ Company warrants that the Software, when used in accordance with the terms of the Rebit™ Software License, substantially conforms to its published documentation. In no event does Rebit™ Company warrant that the Rebit™ Software is error free or that the customer will be able to operate the Software without problems or interruptions.

Extent of Warranty

Customer's sole and exclusive remedy and the entire liability of Rebit™ Company and its suppliers under this limited warranty will be, at Rebit™ Company’s sole option, repair or replacement and at no charge as stipulated herein, with new or reconditioned components, if reported to the Rebit™ Company by the customer during the limited warranty period specified above. All replaced components and products become the property of Rebit™ Company. It is the purchaser’s responsibility to secure all programs and data contained in or affected by any product returned for warranty service. Replacement parts and products assume the remaining original warranty. Rebit™ Company does not warrant uninterrupted or error-free operation of the Rebit™ products, and shall not be liable for the loss or destruction of data or media resulting from the use or service of the product.

The warranty does not cover the repair or exchange of Hardware resulting from misuse; accident; abuse; neglect; misapplication; fire, water, lightning or other acts of nature; unsuitable physical or operating environment; incorrect electrical line voltage, fluctuations, or surges; improper connection with any computer; product alteration or modification; improper or unauthorized disassembly or repair; cosmetic damage or product with altered serial numbers; or failure caused by a product for which Rebit™ Company is not responsible, as determined by the Rebit™ Company. The warranty is voided by removal or alteration of Hardware or any parts or identification labels.

OTHER THAN AS DESCRIBED ABOVE, THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, ORAL OR WRITTEN, ARISING BY LAW OR OTHERWISE, RELATING TO THE HARDWARE OR THE SOFTWARE, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. NO WARRANTIES WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS, SHALL APPLY AFTER THE EXPRESS WARRANTY PERIODS STATED ABOVE, AND NO OTHER EXPRESS WARRANTY OR GUARANTY GIVEN BY ANY PERSON, FIRM OR CORPORATION WITH RESPECT TO THIS PRODUCT SHALL BE BINDING ON REBIT COMPANY. REBIT COMPANY SHALL NOT BE LIABLE FOR LOSS OF REVENUE OR PROFITS, FAILURE TO REALIZE SAVINGS OR OTHER BENEFITS, OR ANY OTHER SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY THE USE, MISUSE OR INABILITY TO USE THIS PRODUCT, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, AND EVEN IF REBIT COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOR SHALL RECOVERY OF ANY KIND AGAINST REBIT COMPANY BE GREATER IN AMOUNT THAN THE PURCHASE PRICE OF THE PRODUCT SOLD BY REBIT COMPANY AND CAUSING THE ALLEGED DAMAGE. WITHOUT LIMITING THE FOREGOING, PURCHASER ASSUMES ALL RISK AND LIABILITY FOR LOSS, DAMAGE OR INJURY TO PURCHASER AND PURCHASER’S PROPERTY AND TO OTHERS AND THEIR PROPERTY ARISING OUT OF THE USE, MISUSE OR INABILITY TO USE THIS PRODUCT SOLD BY REBIT COMPANY. THIS LIMITED WARRANTY SHALL NOT EXTEND TO ANYONE OTHER THAN THE ORIGINAL PURCHASER OF THIS PRODUCT, IS NONTRANSFERABLE AND STATES YOUR EXCLUSIVE REMEDY. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF EXPRESS OR IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU. IN THAT EVENT, SUCH WARRANTIES ARE LIMITED IN DURATION TO THE WARRANTY PERIOD. NO WARRANTIES APPLY AFTER THAT PERIOD.

Items Not Covered by Warranty

Any technical or other support provided for a Rebit™ product under warranty, such as assistance via telephone or webpage with "how-to" questions and those regarding Rebit™ product set-up, will be provided WITHOUT WARRANTIES OF ANY KIND.

Warranty Service

Rebit™ Company's warranty obligations are conditioned upon the return of the affected product in accordance with Rebit™ Company's then-current Return Material Authorization (RMA) policy (click here). The original dated bill of sale must be presented to Rebit™ Company as proof of purchase date. Hardware must be shipped in a securely protected and packaged shipping container and transportation to Rebit™ Company’s RMA location is the responsibility of the purchaser.
